Domain Law

The economic significance of domain names continues to increase. Domain law mainly evolved from trademark and competition law und has meanwhile become an independent branch of law with court ruling being the main input source. Under certain conditions, domains are being protected as a trademark or title, if a homepage or even a web shop is run under this domain. Domains may be traded, transferred, licensed and even seized. As a generic term, they sometimes are very much in demand as a trade object. There are several country codes for the top level domain (TLD) - in Germany this is "de". The most important TLD for business is "com". Recently, the TLD "eu" has been introduced for all countries of the European Union.

For many companies today, in our Internet age, the precondition for success is not only to have an impressive and easy to remember brand but also a corresponding domain. Since the registration of domain names is usually handled on the basis of a "first come, first served" basis, you need to be quick. But before you register a domain you need to make sure that the domain does not infringe on third party rights (brand names, trademarks, titles, names etc.). Otherwise, as with the registration of trademarks, claims to refrain and desist or even for damages might ensue.
